Welcome to Toys Woys, an online marketplace where sellers can list and sell their toys and other related products. By using our platform, you agree to the following terms and conditions:

1. General Terms

1.1. By accessing or using Toys Woys, you confirm that you are at least 18 years old or have parental/guardian permission to use the platform.
1.2. These Terms and Conditions govern the use of our marketplace for both buyers and sellers. 1.3. We reserve the right to update these terms at any time, with notice provided via our website or email.

2. Seller Terms

2.1. Account Registration: Sellers must provide accurate information when creating an account. We reserve the right to suspend or terminate accounts with false or misleading details. 2.2. Product Listings: Sellers are responsible for ensuring that their listings comply with the Bureau of Indian Standards (BIS) and the Toys (Quality Control) Order, 2020. Only BIS-certified toys should be listed for sale. 2.3. Commission Fees: Toys Woys charges a variable commission on each sale. The applicable commission rate will be communicated to the seller before listing products. 2.4. Order Fulfillment: Sellers must ensure timely processing and shipping of orders. Repeated failure to fulfill orders may result in account suspension. 2.5. Refunds & Returns: Sellers must clearly outline their return and refund policies. Any disputes must be resolved between the buyer and the seller, but Toys Woys reserves the right to intervene if necessary. 2.6. Compliance with GST: Sellers must comply with Goods and Services Tax (GST) regulations and ensure proper invoicing for all sales. Toys Woys may require sellers to submit their GSTIN (Goods and Services Tax Identification Number).

3. Buyer Terms

3.1. Buyers agree to provide accurate shipping information and complete payments for purchases. 3.2. Disputes regarding product quality, delivery, or refunds should first be addressed with the seller. If unresolved, Toys Woys may step in as a mediator. 3.3. Unauthorized transactions or fraudulent activities will result in account suspension or legal action. 3.4. Buyers acknowledge that all toys sold on the platform must comply with Indian safety standards and regulations.

4. Payments & Fees

4.1. Transactions are processed through our integrated payment gateways. Sellers will receive payouts after deducting applicable commission fees. 4.2. Buyers are responsible for any additional charges such as shipping fees, GST, or import duties if applicable. 4.3. Toys Woys is not responsible for any payment disputes between the buyer and the seller beyond the standard refund policy.

5. Prohibited Activities

5.1. Sellers and buyers must not:

  • List or purchase illegal, counterfeit, or prohibited items.

  • Sell toys that do not comply with the BIS certification and Indian safety standards.

  • Engage in fraudulent transactions.

  • Misrepresent products in any way.

  • Violate any local, national, or international laws. 5.2. Any violation of these terms may result in immediate account suspension or termination.

6. Liability & Disclaimers

6.1. Toys Woys acts only as a marketplace and is not responsible for the quality, legality, or safety of products sold by third-party sellers. 6.2. We do not guarantee continuous, error-free, or secure access to our services. 6.3. In no event shall Toys Woys be liable for any indirect, incidental, or consequential damages arising from platform use.

7. Termination

7.1. We reserve the right to suspend or terminate any account that violates these terms without prior notice. 7.2. Sellers may request account termination at any time, but pending transactions must be completed before closure.

8. Governing Law & Dispute Resolution

8.1. These terms are governed by and construed in accordance with the laws of India. 8.2. Any disputes arising from the use of Toys Woys shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the venue set in Jaipur, Rajasthan. 8.3. Consumers and sellers retain their rights under the Consumer Protection Act, 2019.
